Student's Bill of Rights
所有举报涉嫌违反学院性行为不端和第九条合规政策或援引本政策中描述的程序的罗伯茨卫斯理学院的学生都有权:
- make a report to local law enforcement and/or state police;
- have disclosure of domestic violence, 约会暴力, 跟踪, and sexual assault treated seriously;
- 决定是否披露犯罪或违规行为，并在没有机构压力的情况下参与司法或行为程序和/或刑事司法程序;
- participate in a process that is 公平, 公正的, and provides adequate notice and a meaningful opportunity to be heard;
- be treated with dignity and to receive from the institution courteous, 公平, and respectful health care and counseling services, where available;

第九条 Definitions

- On the basis of sex,
- That occurs within the College’s Education Program or Activity,
- Within the United States, and

第九条 requires that the College use this definition, from 20 U.S.C. 1092 (f)(6)(A)(v).
约会暴力, Violence committed by a person: (a) who is or has been in a social relationship of a romantic or intimate nature with the victim; and, (b) where the existence of such a relationship shall be determined by (i) the length of the relationship; (ii) the type of relationship; and (iii) the frequency of interaction between the persons involved in the relationship. 第九条 requires that the College use this definition, from 34 U.S.C. 12291(a)(10).
Domestic Violence- Violence committed by a current or former spouse or intimate partner of the victim, by a person with whom the victim shares a child in common, 以配偶、亲密伴侣身份与被害人同居或曾与被害人同居者, 根据国家的家庭暴力法或家庭暴力法，与受害者的配偶地位相似的人, 或任何其他人对成年人或青少年受害者的伤害根据国家的家庭暴力或家庭暴力法，受害者是受保护的. 第九条 requires that the College use this definition, from 34 U.S.C. 12291(a)(8).
跟踪, engaging in a course of conduct directed at a specific person that would cause a reasonable person to: (a) fear for their safety or the safety of others; or (b) suffer emotional distress. 第九条 requires that the College use this definition, from 34 U.S.C. 12291(a)(30).
同意, Affirmative Consent is a knowing, 自愿的, and mutual decision among all participants to engage in sexual activity. Consent can be given by words or actions, 只要这些言语或行为能够明确地表达出参与性行为的意愿. Silence or lack of resistance, in and of itself, does not demonstrate Consent. The definition of Consent does not vary based upon a participant's sex, sexual orientation, 性别认同, or gender expression.
- 同意任何一方之间或与任何一方之间的任何性行为或事先两厢情愿的性活动 does not necessarily constitute Consent to any other sexual act.
- Consent is required regardless of whether the person initiating the act is under the influence of drugs and/or alcohol.
- Consent may be initially given but withdrawn at any time.
- 当一个人丧失行为能力时，就不能给予同意，当一个人 缺乏 the ability to knowingly choose to participate in sexual activity. 使无能力 may be caused by the lack of consciousness or being asleep, being involuntarily restrained, or if an individual otherwise cannot Consent.
